Terms of service
Last Updated: July 11, 2026
These Terms of Service govern your access to and use of [Website URL] and the products and services offered by Same Day DTF Transfer, operated by [Legal Business Name].
Throughout these Terms, “Same Day DTF Transfer,” “we,” “us,” and “our” refer to [Legal Business Name]. “Customer,” “you,” and “your” refer to any person or business accessing the website or purchasing our products or services.
By accessing the website, submitting artwork, placing an order, or using our services, you agree to these Terms of Service and our Privacy Policy and Refund and Cancellation Policy.
1. Eligibility
You must be at least 18 years old or have the permission and supervision of a parent or legal guardian to place an order.
When ordering on behalf of a company, organization, school, team, client, or other entity, you represent that you have authority to accept these Terms on that entity’s behalf.
2. Products and Services
We provide custom DTF transfers, gang-sheet printing, bulk transfer printing, and related design or production services.
Product descriptions, photographs, pricing, sizes, availability, turnaround times, and other website information are provided for general guidance. We may correct errors, update information, discontinue products, impose quantity limits, or reject an order where reasonably necessary.
3. Orders and Acceptance
Submitting an order does not guarantee acceptance. An order is accepted when payment is approved and we confirm or begin processing the order.
We may reject, cancel, or limit an order because of unavailable materials, pricing errors, suspected fraud, prohibited artwork, intellectual property concerns, equipment limitations, production capacity, or other legitimate business reasons.
If we cancel an order before production for reasons unrelated to customer misconduct, we will issue an appropriate refund for the canceled portion.
4. Pricing and Payment
All prices are displayed in U.S. dollars unless stated otherwise. Applicable taxes, shipping costs, rush fees, artwork fees, and other charges will be shown during checkout or provided in a written quote.
Full payment may be required before artwork preparation or production begins.
You authorize us and our payment processors to charge the payment method submitted for your order. You represent that you are authorized to use that payment method and that all billing information is accurate.
5. Customer Artwork Responsibilities
You are responsible for reviewing all artwork, gang sheets, sizes, quantities, spelling, colors, transparency, orientation, placement, resolution, and order specifications before submitting payment.
Files should be print-ready and meet the artwork requirements stated on our website. Low-quality or improperly prepared files may produce low-quality results or delay production.
We may contact you about an obvious issue, but we are not required to inspect or correct every customer-submitted file. Production may begin using the artwork exactly as submitted.
6. Permission to Print Submitted Content
By uploading or providing artwork, you grant us a limited, nonexclusive, worldwide, royalty-free license to store, copy, modify where authorized, reproduce, and print the submitted content solely as necessary to process your order, provide customer support, maintain appropriate records, and operate our services.
You retain ownership of the rights you lawfully hold in your artwork.
We will not claim ownership of your customer artwork merely because it was uploaded or printed by us.
7. Intellectual Property Representations
You represent and warrant that you own the submitted artwork or have all licenses, permissions, releases, and legal authority necessary for us to reproduce and print it.
You may not submit content that infringes another person’s copyright, trademark, publicity right, privacy right, or other intellectual property or proprietary right.
We are not responsible for determining ownership of customer-submitted content. We may reject, suspend, or cancel an order when we reasonably believe the artwork may violate another party’s rights.
You agree to be responsible for claims arising from artwork or instructions you provided without proper authorization.
8. Prohibited Content
You may not use our services to produce content that is unlawful, fraudulent, threatening, defamatory, exploitative, or that encourages illegal activity.
We may also refuse content that creates a credible safety risk, violates another person’s rights, or may expose our business or personnel to legal liability.
Our decision not to print particular content does not mean that we have reviewed or approved other customer-submitted content.
9. Proofs and Approval
When a digital proof is provided, you are responsible for reviewing and approving all details before production.
Approval confirms that the spelling, sizing, layout, quantities, placement, and visible design details are acceptable. Changes requested after approval may result in additional fees or require a new order.
A proof displayed on a screen is not a guarantee of exact printed color, texture, size, or appearance.
10. Printing Variations
DTF printing may involve reasonable variations in color, dimensions, texture, placement, finish, opacity, and appearance.
Colors may differ from those displayed on electronic screens. Exact color matching is not guaranteed unless expressly included as a separate service.
Reasonable production variations that do not materially affect the usability of the product are not considered defects.
11. Turnaround Times and Rush Orders
Production and completion dates are estimates unless we expressly guarantee a deadline in writing.
Same-day service depends on the time the order is received, payment confirmation, artwork readiness, order volume, size, requested services, materials, equipment availability, and current production capacity.
Orders requiring artwork correction, background removal, resizing, communication, or proof approval may require additional time.
A customer should not schedule an event, sale, production run, or delivery commitment based solely on an estimated completion date without allowing reasonable additional time.
12. Local Pickup
Customers must wait for pickup confirmation before arriving.
The person collecting the order may be required to provide the order number, customer name, identification, or other reasonable verification.
You are responsible for inspecting the quantity and visible condition of the order promptly after pickup and reporting eligible concerns according to our Refund and Cancellation Policy.
13. Shipping and Risk
Customers are responsible for providing a complete and accurate shipping address.
We are not responsible for delays, losses, additional charges, or failed deliveries caused by an incorrect customer-provided address.
Delivery dates provided by carriers are estimates. Carrier delays and other circumstances outside our reasonable control may affect delivery.
Risk of loss transfers as permitted by applicable law. Contact us promptly if an order is lost or damaged so that we can determine whether a carrier claim or other resolution is available.
14. Transfer Application
Application results depend on the heat press, garment, fabric, pressure, temperature, pressing time, peeling method, artwork, storage, and operator technique.
You are responsible for reviewing application instructions and testing a sample before applying transfers to valuable garments or completing a full production run.
We are not responsible for damaged garments, wasted inventory, labor costs, lost profits, customer refunds, or other losses caused by improper application, incompatible materials, or failure to test the product.
15. Refunds and Cancellations
All refunds, cancellations, replacements, reprints, defective-product claims, and shipping claims are governed by our Refund and Cancellation Policy, which is incorporated into these Terms.
Because custom products cannot normally be resold, custom orders generally become final once production begins.
16. Website Intellectual Property
The website and its original text, graphics, photographs, logos, product descriptions, layout, and other content are owned by or licensed to us and are protected by applicable intellectual property laws.
You may not copy, reproduce, distribute, modify, sell, exploit, or create derivative works from our website content without written permission, except as permitted by law.
17. Reviews and Feedback
When you voluntarily submit a review, testimonial, photograph, suggestion, or other feedback for publication, you grant us permission to display, reproduce, and use that content for legitimate business and promotional purposes.
You represent that your submission is truthful, based on your actual experience, and does not violate another person’s rights.
We will not falsely attribute a testimonial to you or materially alter the meaning of your review.
18. Third-Party Services
Our website may rely on or link to third-party services, including payment processors, ecommerce platforms, shipping carriers, social networks, and external websites.
We do not control and are not responsible for the availability, terms, security, content, or practices of independent third parties.
19. Disclaimer of Warranties
To the maximum extent permitted by law, the website and services are provided on an “as available” basis.
We do not guarantee that the website will always be uninterrupted, error-free, secure, or free from harmful components.
Except for warranties that cannot legally be excluded, we disclaim implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
20. Limitation of Liability
To the maximum extent permitted by law, Same Day DTF Transfer and its owners, employees, contractors, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost business, lost production, damaged garments, or loss of data arising from the website, products, or services.
To the maximum extent permitted by law, our total liability concerning a particular order will not exceed the amount you paid directly to us for the affected portion of that order.
Some jurisdictions do not permit certain exclusions or limitations, so some provisions may not apply to you.
21. Indemnification
To the maximum extent permitted by law, you agree to indemnify and hold harmless Same Day DTF Transfer and its owners, employees, contractors, and agents from third-party claims, losses, liabilities, costs, and reasonable legal expenses arising from customer-submitted artwork, your violation of another party’s rights, your unlawful use of the services, or your material violation of these Terms.
22. Events Outside Our Control
We will not be responsible for delays or failures caused by events outside our reasonable control, including severe weather, natural disasters, utility or internet outages, equipment failure despite reasonable maintenance, supply shortages, labor disruptions, carrier delays, governmental actions, emergencies, or similar events.
23. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules.
Any legal proceeding relating to these Terms or our services must be brought in a court with appropriate jurisdiction located in Kern County, California, unless applicable law requires otherwise.
24. Severability
If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the greatest extent permitted, and the remaining provisions will remain effective.
25. No Waiver
A failure to enforce any provision of these Terms does not waive our right to enforce that provision or any other provision later.
26. Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted on this page with a revised “Last Updated” date.
Changes will apply to future use of the website and future orders unless otherwise required by law.
